Terms & Conditions

       Competition Overview:

  • The competition will launch in the September edition of British Vogue magazine on 6 August 2021.
  • Entrants can download a template of a classic Beaufort wax jacket from the Barbour website.
  • Using the template entrants will submit their design idea to Barbour.
  • Entries close on 12 September 2021 at 11.59pm and 5 finalists will be shortlisted after this date by the Barbour Design Team.
  • The five finalists will visit Barbour House and meet the design team on 20 and 21 September.
  • These 5 jackets will be brought to life using vintage Beaufort jackets from the Barbour ‘Re-Loved’* programme.
  • A panel of judges will select a winner w/c 29 November 2021 – this will take place in London on a date to be confirmed.
  • The winner will receive £5,000 and they will feature in a photoshoot in the April edition of Vogue alongside their completed jacket.
  • The five finalists’ jackets will be sold to raise money for charity.

       * Barbour Re-Loved is an upcycling programme  whereby previously owned wax jackets are returned to us and given a new lease of life so they can be re-loved in a new home for many more years to come.

 

Terms and Conditions

These terms and conditions (the “Competition Terms”) are the terms and conditions that apply to the Barbour X Vogue Design Competition (the “Competition”) promoted by J Barbour & Sons Ltd (‘Barbour’) “we” or “us”.

We may change these Competition Terms at any time. You should check our website regularly for any changes, which will apply from the date that they are uploaded.

All entry instructions also form part of these Competition Terms.

By entering the Competition you agree that you will be legally bound by these Competition Terms.

Barbour is a company registered in England and Wales with company number 124201 and with its registered office at Simonside, South Shields, NE34 9PD.

The Competition is open to all persons over the age of eighteen (18).

The winner / finalists must be available to take part in a design day on 20 and 21 September in Barbour’s HQ in South Shields, Tyne and Wear, a winner’s reception on a date to be confirmed in w/c 29 November in London and a photoshoot in December (again, with date to be confirmed) in London.

We reserve the right to disqualify any entry which does not comply with these Competition Terms.

Employees (and their immediate family and household members) of Barbour and Condé Nast (Vogue), their service providers and wholesale partners or members of their families or households may not enter the Competition.

The entry requirements are a completed design template showcasing the entrants original design idea. Please note that any hard copy entry forms will not be retained and postage must be paid by the entrant.

Entries must be submitted either by email to [email protected] or by post to PR Department, J Barbour & Sons Ltd, Unit 50, Barbour House, Bedesway, Bede Industrial Estate, Jarrow, Tyne and Wear, NE32 3EG.

All entries must arrive no later than 11.59pm on 12 September 2021.

Entry submissions must include the entrant’s contact details. Entries which fail to do so will be void and not considered within the Competition. Email entries are deemed to be received on arrival, not when they are sent from your email account. The entry form can be found here. Postal entries must arrive at the address set out above no later than 11:59 at 12 September 2021.

We accept no responsibility for any late, lost or misdirected entries, including but not limited to emails not received due to technical disruptions, network congestion or any other reason and post that has been delayed.

Unfortunately, entries cannot be returned and neither Barbour nor Vogue, nor the members of the judging panel, can give individual feedback to any entrant.

Deficient entries: we reserve the right to reject any entries that are incomplete, incomprehensible, damaged or otherwise deficient. We also reserve the right to reject entries that are unlawful, indecent, discriminatory in any way, inflammatory, defamatory or which we consider to be in bad taste or otherwise harmful to the goodwill and reputation of any the publication, websites or brands.

Names: entrants must enter the Competition using their legal name only once. We reserve the right to disqualify any entrant who uses multiple names.

Multiple entries. No person may enter the Competition more than once and persons may not enter or participate as part of a syndicate or on behalf of any other person, syndicate, group, society or company.

Prize limits. The prize is:

Participation in a photoshoot with Vogue

The prize cannot be exchanged or passed onto anyone else. The prizewinner must accept prizes in the form offered. There is no cash alternative for non-cash prizes.

Retrospective effect. Where an entrant or prizewinner has been found to be in breach of any of the terms and conditions of the Competition and in particular where a person is in breach of the entry restrictions set out in rules above, we may disqualify that person and require the return or reimbursement to us of any prize even where a prize has been awarded and/or actually provided to the entrant or prizewinner in question.

The prizewinner will be notified that they have won at the winner’s reception on w/c 29 November (such date to be confirmed). All finalists must attend or will otherwise be disqualified. If, due to extenuating circumstances, the reception is not held in person then an online reception will be held instead. The prizewinner will be announced in British Vogue Magazine’s April 22 issue, and also on the British Vogue website and Barbour digital channels. Should the prizewinner’s details change, it is their responsibility to notify us. The prizewinner and finalists may not announce the winner of the competition until instructed in writing to do so by Barbour.

A shortlist of five finalists will be made, one winner will be selected from this shortlist by the panel of judges. Their decision shall be final and there is no appeal against their decision.

For finalists and the prizewinner, paid travel and accommodation will be arranged by Barbour for the shortlisted entrants’ attendance at the design days at Barbour HQ in South Shields (North East England) and also the winner’s reception in London. The winner will receive paid travel and accommodation to take part in the photoshoot in London. Expenses will only be paid for travel within the United Kingdom and any legal travel restrictions that are in force at the time will be observed and arrangements changed where necessary.

Other than those specified above, the promoter shall not be liable for any costs or expenses arising out of or in any way connected with this prize and does not accept any responsibility for any damage, loss or disappointment suffered by the winner as result of accepting this prize.

We reserve the right to request proof of a prizewinner’s identity in the form of a passport or driver’s licence and proof of address in the form of a utility bill. In the event that a prizewinner cannot provide us with proof of identity reasonably acceptable to us, we may withdraw the prize and select another prizewinner.

All prizes are subject to availability, nontransferable and non-exchangeable. No cash will be awarded in lieu of that prize or part of it.

Any tax payable as a result of a prize being awarded or received will be the responsibility of the winner. Winners should seek independent financial advice prior to accepting a prize.

We make no representation or warranty in relation to prizes provided and to the fullest extent permitted by law we shall have no liability to you in relation to any prize, its fitness for purpose, merchantability or otherwise. We reserve the right to disqualify entrants from entering our Competition or prizewinners from receiving their prizes where any such person engages in immoral or illegal behaviour or behaviour that is damaging to the brand reputation of either Barbour or British Vogue in any way.

The personal information supplied by entrants when entering the Competition or otherwise requested by us, will be used by us in accordance with our privacy policy, which can be found at https://www.barbour.com/uk/privacy-policy. You should always read the privacy policy as your entry in the Competition is an agreement to be bound by the privacy policy.

It is a condition of your entry to the Competition that we have the right to publicise the names of entrants and otherwise to process your personal information for the running of the Competition.

All entrants and particularly the prizewinner, may be required by us to participate in photo, recording, video and/or film session(s). In this regard you agree that we shall have the right to use all the resulting marketing and publicity materials in any medium (including, without limitation, the internet), on a commercial basis and in any manner we see fit for no further fee.

Entrants also acknowledge that marketing and publicity materials featuring them may be provided to and used by our third-party prize providers (including specifically Vogue) for the purposes of promoting their association with the Competition and awarding the relevant prizes.

No fees shall be payable to any entrant in relation to their entry in the Competition or any publicity relating to the Competition save for the prize.

By entering the Competition entrants warrant and undertake that the information submitted is true, accurate and complete.

By entering our Competitions all entrants:

undertake to us that their entry is not in breach of any third-party intellectual property rights and will not contain anything, which is defamatory, discriminatory in any way, indecent, harassing or threatening and that they will indemnify us for any loss, damage or liability arising should this turn out not to be true. If relevant, we reserve the right, but not the obligation (and without limiting entrants’ warranty and indemnity as set out above), to screen, filter and/or monitor information provided by the entrant and to edit, refuse to distribute or remove the same;

For the avoidance of doubt, all rights in the name and title of the Competition and the format rights for the Competition are our sole property and we may exploit the same with our absolute discretion.

If for any reason the Competition is not capable of running as planned as a result of any (including but not limited to) a lockdown or restriction imposed by the government, technical failures, unauthorised intervention, computer virus, mobile network failure, tampering, fraud or any other causes beyond our control which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Competition, we reserve the right to cancel, terminate, modify or suspend the Competition and/or any draw or judging related to the Competition and/or to disqualify any individual who (whether directly or indirectly) causes (or has caused) the problem.

Obtaining time off work and/or study or related activities to participate in a Competition and/or take a prize will be the sole and absolute responsibility of each contestant.

All entrants agree that should their design be shortlisted and produced it will go on to be sold to raise funds for a charity (such details to be confirmed). Entrants may not retain their jacket and secondary copies of the jacket cannot be made.

The entrants hereby grant to Barbour an irrevocable, perpetual, royalty-free licence to use their design for the purpose of Barbour selling the shortlisted jacket for the benefit of the nominated charity.  Barbour will not use the entrant’s design for commercial purposes and the entrant will retain all intellectual property rights in their design submission although will not gain any pre-existing intellectual property rights in the Barbour Beaufort jacket design which will remain the property of Barbour.

We may vary the terms of, or terminate, the Competition at any time at our absolute discretion without liability to any contestant or other person. We will not award the prizes if the Competition is terminated.

All our decisions relating to the Competition including the decision of the judges and/or redemption of the prizes are final. No discussions or correspondence with entrants or any other person will be entered into.

Any disputes, conflicts, questions or concerns will be managed and resolved by us.

A failure by us to enforce any one of the terms and conditions in any instance(s) will not give rise to any claim or right of action by any entrant or prizewinner, nor shall it be deemed to be a waiver of any of our rights in relation to the same.

Except as specifically set out herein and to the maximum extent permitted by law, all conditions, warranties and representations expressed or implied by law are hereby excluded.

To the fullest extent permitted by law, we hereby exclude and shall not have any liability to any entrant or prizewinner in connection with or arising out of the Competition howsoever caused, including for any costs, expenses, forfeited prizes, damages and other liabilities, provided that nothing in these Competition Terms shall operate so as to limit or exclude our liability for personal injury or death caused by our negligence. For the avoidance of doubt, this paragraph shall also apply in respect of any prize provided by a third-party provider and to any social networking site (where the Competition is hosted by a social networking site).

Where the competition is accessed via a social networking site, the Competition is in no way sponsored, endorsed, administered by or associated with that social networking site.

These Competition Terms shall be construed in accordance with and governed by the laws of England and Wales and any disputes arising from the Competition shall be subject to the exclusive jurisdiction of the courts of England and Wales.
